President Trump said he wants to unilaterally terminate the automatic right to citizenship for children born in the U.S. to noncitizens, a suggestion that drew mixed reactions from fellow Republicans and that legal experts said would be unconstitutional.
“It’s in the process. It’ll happen, with an executive order,” Mr. Trump said in an interview with Axios published Tuesday morning, further escalating his tough stance on immigration ahead of the midterm election. – WSJ
This had to happen one day!
In most countries, a child does not get citizenship automatically in a country that he or she is born. If President Trump gets rid of automatic citizenship by birth policy, it will not be radically different than any other country.
The theory of children born in the United States should automatically be US citizen has not been tested in a court. Although the constitution vaguely mentions about it, it does not talk about the children born to people who are not supposed to be in the United States. The founders most likely were referring to children born to at least one US parent but that remains to interpretation.
President Trump’s executive order will face multiple legal challenges obviously.
